Protecting Your Rights When Facing DUI Charges

In the state of Illinois, you can be charged with a DUI if you have a blood alcohol concentration of .08 or more, or if you are driving under the influence of drugs. The consequences of DUI charges can be serious. You may lose your license, pay hefty fines and spend time in jail. You must complete required community service and have a breath alcohol ignition interlock device installed in your car. If you have been arrested or charged with a DUI, contact a Bloomington DUI defense lawyer as soon as possible.

The Consequences Of A Conviction Can Be Severe

The penalties for a DUI charge in Illinois increase with each offense. If it is your first offense, you will have to pay a fine of up to $2,500, and your license is suspended for a minimum of one year. If convicted of a second offense, you will be required to spend five days in jail or perform at least 240 hours of community service, pay a harsher fine and potentially face the loss of your license for up to three years. A third offense is considered a felony. For cases considered to be high risk, you will be required to attend 85 hours of alcohol treatment or class time.

If you are convicted of aggravated DUI, you must perform a minimum of 480 hours of community service or 10 days of imprisonment. An aggravated DUI includes:

  • A second DUI while transporting a minor of age 16 or under
  • A third or more DUI
  • A DUI resulting in an accident that causes great bodily harm
  • A DUI while your license is revoked or suspended
  • A DUI while you knew, or should have known, that you do not have insurance

At Wright Law Office, we have extensive experience handling DUI cases. We work to minimize the consequences and protect your rights.

Restoring Driving Privileges

Having your license suspended or revoked entirely impacts your ability to get to work, to attend court-ordered alcohol treatment classes and to get on with daily life. We work to prevent your license from being revoked or get your driver's license reinstated by arranging a hearing. We are often able to negotiate with the court to obtain a driving permit, so you can drive to your treatment classes, work or school.
